What Is the Difference Between Auto Theft & Carjacking?
Auto theft typically does not involve direct confrontation with the vehicle’s owner. Auto theft usually occurs without the owner’s knowledge, presence, or interaction. For example, stealing a parked car from a driveway is auto theft.
Conversely, carjacking involves the use of force, threats, or intimidation to steal a vehicle directly from its owner or driver. Carjacking involves theft and the element of violence or threat of violence. An example is someone threatening a driver at a stoplight with a weapon and demanding that the driver exit the vehicle.
While Utah law does not explicitly use the term “carjacking,” the crime falls under aggravated robbery statutes (Utah Code § 76-6-302). If someone uses force or fear to take a vehicle directly from another person, it is prosecuted as aggravated robbery. Per Utah law, this is charged as a first-degree felony.
